Webinar: Draft B-BBEE Code Amendments Gazetted on 29 January 2026

New procurement rules. A new Transformation Fund. New compliance risks and opportunities.

On 29 January 2026, the Department of Trade, Industry and Competition (DTIC) gazette draft amendments to the B-BBEE Codes of Good Practice, opening them for 60 days of public comment (closing 30 March). These are not cosmetic changes. Once implemented, the amendments will fundamentally change how B-BBEE points are earned, how procurement must be structured, and how Enterprise and Supplier Development(ESD) contributions are measured and verified.

Why this matters to your organisation

  • A Transformation Fund is introduced as a priority element, contributing up to 20 points for contributions of 3% of NPAT.
  • Failure to achieve 40% of the Transformation Fund target could result in a B-BBEE level drop.
  • Preferential Procurement points are reallocated away from “51% Black-owned” suppliers toward 100% Black-owned and 100% Black women-owned suppliers.
  • As many as 14 points may now be driven by procurement from 100% Black-owned EMEs, QSEs and large enterprises
  • Existing procurement strategies, supplier mix, and ESD models may become misaligned overnight.

In short, many current scorecard strategies will no longer be optimal or sufficient.
